미국내 성매매는 주정부의 권한으로 합법이나 위법으로 정할 수 있으나, 네바다주와 로드아일랜드 주를 제외한 모든 주정부에서 불법으로 금하고 있습니다. 네바다주의 경우 주민이 40만명 이상의 지역에서는 성매매를 할 수 없습니다. 로드아일랜드 주의 경우 성매매 행위 자체는 합법이나, 길거리에서 호객행위를 하거나 성매매 목적 업소를 운영하는 것은 불법입니다. 거의 모든 주정부에서 성매매로 체포될 경우 경범죄로 처벌되고 있습니다.
